On November 6th a 44-year-old Anacortes woman was arrested on a charge of DUI after a citizen called police with a concern that an obviously intoxicated woman purchased alcohol at a West End convenience store and drove away around 11:31 a.m. Officers found the woman and her vehicle at a nearby residence. She allegedly failed physical sobriety tests and claimed she was taking medication that could cause impairment. She was arrested and was taken to the hospital for a blood test.
Comment: Seriously? Based on these facts there may not be any probable cause to contact (see Campbell v. DOL). Good defenses are available in this case.
