On December 21, 2010, an Anacortes police officer on routine patrol spotted a driver using a cell phone in the 1700 block of Commercial Avenue in Anacortes, Skagit County at 9:09 p.m. The Anacortes officer pulled over the vehicle and observed the 30-year-old Anacortes man appeared intoxicated. After allegedly failing field sobriety tests the man was arrested and taken to the Anacortes police station for a blood-alcohol test.
