Lynnwood DUI Attorney: Suspected DUI driver not drunk but dead
A 68-year-old man was found dead in his car after it started down the wrong way on an Interstate 5 offramp in Lynnwood Tuesday evening.
The man may have died from a medical problem before the car drifted off the ramp and came to a stop without hitting any other vehicles or objects, said Washington State Trooper Mark Francis.
The Snohomish County Medical Examiner's Office is investigating.
Francis said the man appeared to have been driving on
Witnesses found the man unresponsive, and he was pronounced dead at the scene.

A measure that would stiffen sentencing laws for driving under the influence has cleared the Washington Legislature.
A measure that would stiffen sentencing laws for driving under the influence has cleared the Washington Legislature.
House Bill 1789, which broadens the prosecution of felony DUI, now goes to Gov. Chris Gregoire for approval.
The News Tribune says the bill would make any subsequent DUI conviction a felony, if an offender has a prior felony DUI conviction. The measure also requires a person convicted of alcohol-related reckless driving or negligent driving to install a device that prevents a car from starting if alcohol is detected.

Seattle King County DUI Attorney: Seattle police officer arrested for 2nd DUI

A Seattle police sergeant was arrested April 3 on suspicion of drinking and driving, his second such arrest in six years.
Sgt. Scott Moss was driving north on Interstate 405 near Newcastle when he was pulled over at 5:05 a.m., said Trooper Cliff Pratt, a spokesman for the State Patrol.
Moss, 41, was driving his personal vehicle, a blue Jeep Cherokee, and a trooper saw it drifting back and forth between the far right lane and the freeway's shoulder, Pratt said. The trooper smelled intoxicants after approaching Moss, a 16-year veteran of the department who served as a department public-information officer several years ago.
Moss' blood alcohol content (BAC) was measured at .069 and .075 percent, according to Pratt. Though that was below the legal limit of 0.08, Pratt noted that the tests weren't performed until well over 1 ½ hours after Moss' arrest, though the reason for the delay was not immediately known.
"He did identify himself as a police officer," Pratt said. "Throughout the whole thing Scott was courteous and polite, and toward the end of it he was apologetic for the situation."
Moss, who is assigned to the West Precinct, was taken to the Issaquah City Jail for processing, then released to a Seattle police commander, Pratt said.
Moss was arrested in 2005 in Bremerton on investigation of DUI, a charge later amended to first-degree negligent driving. After his arrest, Moss was removed from his job as a department spokesman.

Distracted driving is the new DUI

Matt Wilhelm was killed in September 2006 when a teenage driver, downloading a ring tone to her cell phone in Urbana, went off the road and hit him.

John "J.B." Breen was texting while driving in 2009, lost control of the vehicle, went off the road and crashed, killing himself.

Linda Doyle was killed in 2008 when a driver just ending a phone call ran a red light and broadsided her car.

By sharing the stories of families impacted by distracted driving, organizers of the first-ever Illinois Distracted Driving Summit, held Thursday in Addison, hope people will become more aware — and laws will be strengthened — to change driver behavior.

"Each year, thousands of families needlessly lose loved ones" due to distracted driving — people texting, using a cellphone or hands-free device while driving, said Jennifer Smith of Focus Driven. The advocacy group was one of the major sponsors of the summit.

"We want to help develop a resource … to get people involved and help change behaviors" of drivers, Smith said.

Focus Driven also hopes the Illinois conference, which included U.S. Transportation Secretary Ray LaHood and Illinois Secretary of State Jesse White as keynote speakers, will encourage other states to hold similar events, she added. "We can save countless lives across the country," Smith said.

The data exist to indicate how dangerous distracted driving is, LaHood told the 500-plus people attending the conference.

In 2009, the last year for which data are available, there were 5,500 deaths and 450,000 injuries across the country blamed on distracted driving.

"That is the tip of the iceberg," LaHood said, noting that most police reports don't document if distraction was involved in a crash.

Public awareness

LaHood and Janet Froetscher of the National Safety Council started Focus Driven in 2009 when they were waiting to be interviewed by CNN, LaHood said. Just as Mothers Against Drunk Drivers and Students Against Drunk Drivers created more public awareness — and more social stigma — regarding drunken driving, they hope Focus Driven can bring that same awareness to the issue of texting or talking on the phone and driving.

Distracted driving is an epidemic "because everybody in this room has one of these," LaHood said, holding up a cellphone. "I know the majority of people in this room have one of these; and as much as you care now … we all think we can use these anytime, anyplace, anywhere. It has created bad behavior behind the wheel of a car."

There are some laws in Illinois to prevent distracted driving, including a law that prohibits all driving and texting, and laws prohibiting talking on a cellphone in a school or construction zone, White said.

Graduated driver's license laws also have helped reduce fatal crashes involving teens, White said.

"Our (fatal teen crash) numbers have dropped by 50 percent since we added graduated driving licenses," White said.

The Illinois Department of Transportation and police report that for the past two years, there have been fewer than 1,000 deaths on Illinois highways. But White said, "One death is one too many."

Like the work it took to toughen up child restraint and seat belt laws, LaHood said, it will take work to get tougher distracted driving laws passed.

"We do see that drivers will change their behavior," he said.

Toughening laws

Programs such as Click it or Ticket have led to 85 percent of motorists using their seat belts "after 20 years of pounding into their heads … and police writing tickets," he said.

Reducing the blood alcohol limit to .08 percent to be legally intoxicated also has helped to reduce the number of drunken drivers and increased the ability to prosecute them, LaHood said.

Still, said Chuck Wilhelm, father of Matt Wilhelm, Illinois law has not caught up with technology. The teenage girl who hit and killed his son was charged only with improper lane usage because there is no law for negligent vehicular homicide here.

"Even the judge was frustrated," he said. "He couldn't even give her community service."

On April 8th in Anacortes an Anacortes police officer saw a vehicle eastbound on Highway 20 in Anacortes drifting noticeably outside its lane around 12:57 a.m. The driver, a 23-year-old woman, smelled of alcohol and her speech was allegedly lethargic and slurred. She failed field sobriety tests (which according to NHTSA you cannot fail) and was arrested on a charge of DUI in Anacortes. She was cited and released to her mother.

On April 6th an Anacortes police officer on patrol in the 2700 block of Commercial Avenue in Anacortes saw a vehicle that appeared to be speeding around 10:06 p.m. A radar reading confirmed the vehicle's speed to be 39 mph in the 30 mph zone. The driver, a 39-year-old Anacortes man, allegedly showed signs of intoxication. He agreed to perform voluntary field sobriety tests which he failed (which NHTSA says you cannot fail). He was cited on a charge of DUI in Anacortes and released to a sober adult.

On April 5th in Anacortes an Anacortes police officer on patrol around 12:11 a.m. saw a vehicle associated with a 45-year-old Anacortes man who had arrest warrants. After the vehicle pulled into a business in the 1100 block of 12th Street in Anacortes, the Anacortes police officer contacted the man as he got out of the vehicle. The man denied having warrants and gave a different name, but identity was confirmed and he was arrested.

 

This Anacortes driver allegedly showed signs of drinking and an open alcohol container was in plain view inside his vehicle. He failed field sobriety tests (which NHTSA says you cannot fail) and refused the breath test. He faces charges of DUI and obstruction. He was booked into jail on the warrants.

Anacortes Skagit County DUI Lawyers: Anacortes Police Blotter April 1

Employees of a business in the 2400 block of Commercial Avenue called to complain about a woman who appeared to be under the influence of drugs bothering customers and refusing to leave the store around 6:55 p.m. Tuesday, April 5.

When officers arrived they were told she locked herself in the women's restroom. Officers managed to talk her into coming out of the restroom and she consented to a voluntary search of the bag she was carrying to confirm she did not have any weapons.

During the search, an unmarked bottle of pills was found. She claimed to have prescriptions for all the pills. The bottle was temporarily seized until her doctor confirmed the prescription. She was warned about carrying prescription medications out of the marked bottle.

Among the other 191 cases handled by Anacortes police during the previous week:

Friday, April 1

• Officers responded to the 900 block of M Avenue about a man yelling profanities at people around 6:57 p.m. As officers arrived, a second call was received reporting a man urinating in a yard near 10th Street and L Avenue. Officers found the obviously intoxicated man and tried to help him arrange a ride home. He allegedly became very aggressive towards officers, yelling they were "persecuting" him. The officers decided to handcuff him for safety reasons and he began kicking and cursing at the officers. The man was eventually restrained and booked into jail on charges of disorderly conduct and resisting arrest.

• A resident of the 1800 block of Copper Pond Place reported receiving mail that had already been opened. It is suspected the mail was originally delivered to the wrong address and opened before the error was noticed.

• A woman drinking at a business in the 400 block of Commercial Avenue reported she believed someone drugged her beverage. She said she had a very strong reaction after partially consuming one drink. There was no evidence anyone tampered with her drink.

Saturday, April 2

• An officer on patrol in the 1000 block of Seventh Street saw a large crowd gathered outside a drinking establishment around 1:08 a.m. The officer saw one person push another, knocking him to the ground. The man who was pushed did not wish to pursue charges. Both parties were told to leave the area.

• Parents of a 16-year-old girl reported a person their daughter is temporarily living with signed papers giving permission for her to get a driver's license against the parents' wishes. The driver's license was placed on hold pending a court decision on guardianship. No charges were filed.

• A witness called 911 after seeing a woman who appeared to be trying to get out of a moving vehicle in the 1000 block of 20th Street around 6:43 p.m. Officers determined a man and woman had been arguing and she tried to get out of the vehicle as it turned the corner. Once the vehicle was stopped, she got out and tried to walk away. A 50-year-old Anacortes man chased her and grabbed her jacket, preventing her from leaving. He was arrested and booked on a charge of domestic violence assault.

Sunday, April 3

• A woman returned home and found her locked bedroom door was forced open and her room ransacked. The house was possibly entered through an unlocked door. During the original complaint the woman could not identify that anything was taken but later reported missing a box of checks. The account was canceled and officers are interviewing some former residents of the house.

• A landscaping rock was thrown through the rear window of a vehicle parked in an apartment complex in the 1000 block of 29th Street. No other vehicles were damaged. The vehicle owner could not think of anyone who might be motivated to damage his property.

• A resident of the 3900 block of View Ridge Way called at 9 a.m. to report a suspicious man in the area at 2 a.m. The reporting party told the man the police were being called and he fled. Officers told the reporting party to tell her neighbors of this incident and to call 911 immediately if it should occur again.

• A business in the 1600 block of 22nd Street was entered during non-business hours. A cash box was pried open and some of the contents were taken.

• Two women got into a fight outside a business in the 300 block of Commercial Avenue around 1:30 a.m. The reporting party wanted the incident documented in case of future incidents. No charges were filed.

• A resident of the 1400 block of 18th Street reported contacting a suspicious person attempting to enter her neighbor's house. The juvenile suspect fled but was found a few blocks away. The suspect was booked into juvenile detention and faces an attempted burglary charge.

Monday, April 4

• A man reported his wife was missing from their house on Oakes Avenue since 1:30 the previous afternoon. Officers tried to find and contact the woman for the next 12 hours. She returned home at 5:30 p.m. and said she just needed some time to herself.

• A suspicious man was reported hanging around in the area of the 1700 block of 36th Street around 4:30 p.m. The 46-year-old transient said he was waiting for his girlfriend while she visited her mother. The girlfriend confirmed his story.

The officer was later told of a no-contact order between the couple. The information provided by the transient contacted came back with no record but his identity was confirmed with a booking photo on file. Officers arrested him on a charge of violating the no-contact order.

• An employee of a business in the 900 block of 11th Street was arrested, cited and released after allegedly confessing to stealing items belonging to the store.

• A digital camera was stolen from a patron of a business in the 300 block of Commercial Avenue around 11 p.m. the previous night. The victim suspects two men who asked her and her friend to dance took the camera after they turned down the dance invitation.

Tuesday, April 5

• An officer on patrol around 12:11 a.m. saw a vehicle associated with a 45-year-old Anacortes man who had arrest warrants. After the vehicle pulled into a business in the 1100 block of 12th Street, the officer contacted the man as he got out of the vehicle. The man denied having warrants and gave a different name, but identity was confirmed and he was arrested.

He allegedly showed signs of drinking and an open alcohol container was in plain view inside his vehicle. He failed field sobriety tests and refused the breath test. He faces charges of DUI and obstruction. He was booked into jail on the warrants.

• A 15-year-old girl was detained for theft after allegedly being seen shoplifting a pair of sunglasses from a business in the 1500 block of Commercial Avenue. She was released to her parents. Charges were referred to the court.

• A club that meets in the 900 block of Sixth Street reported being told the day before that unauthorized people were in their area of the building. Clothing items belonging to the club were later found missing. Juveniles suspects were interviewed. The clothing is being recovered and possible criminal charges are pending.

• A 22-year-old Anacortes man was booked into jail on investigation of felony harassment after his 18-year-old estranged wife reported receiving text messages from him threatening to kill her and her new boyfriend and then run away with their children. The woman said she believed her husband was capable of carrying out his threats and she feared for her safety. The man reportedly initially denied making the threats but eventually admitted he sent the text in anger but hadn't really meant it.

Wednesday, April 6

• An officer on patrol in the 1200 block of Commercial Avenue saw a vehicle driven by a 20-year-old woman known to have a suspended driver's license. The vehicle pulled into the woman's driveway and the officer saw her run into the house. Her mother then came out and claimed to have been driving. The young woman came outside and the officer began to take her into custody. She reportedly resisted, punching the officer in the chest with a closed fist, and her mother also attempted to interfere. Other officers arrived and all parties were separated. The young woman was booked into jail on charges of assaulting a police officer. Her mother faces charges of allowing an unauthorized person to operate her vehicle and obstruction.

• An officer on patrol in the 2700 block of Commercial Avenue saw a vehicle that appeared to be speeding around 10:06 p.m. A radar reading confirmed the vehicle's speed to be 39 mph in the 30 mph zone. The driver, a 39-year-old Anacortes man, showed signs of intoxication. He agreed to perform voluntary field sobriety tests which he failed. He was cited on a charge of DUI and released to a sober adult.

Thursday, April 7

• A second rock was thrown through the newly repaired window of the vehicle that was vandalized on April 3. A witness heard the crash and saw a man run toward Storvik Park around 3:40 a.m. The victim told police he has no idea why he is being targeted.

• A boat owner reported sometime since January a $4,000 outboard motor was stolen from his boat moored in the Skyline Marina.

• A 45-year-old man reported he was in an argument with his 24-year-old daughter, who slapped him and left the area in a vehicle. Officers contacted the daughter, who was arrested on outstanding warrants. Three baggies of suspected marijuana reportedly were found in her pockets and purse. As officers tried to seat her in the patrol car she allegedly began kicking the car and bracing her legs in the door jamb. She was taken to jail and booked on the warrants and new charges of domestic violence and resisting arrest.

Friday, April 8

• An officer saw a vehicle eastbound on Highway 20 drifting noticeably outside its lane around 12:57 a.m. The driver, a 23-year-old woman, smelled of alcohol and her speech was lethargic and slurred. She failed field sobriety tests and was arrested on a charge of DUI. She was cited and released to her mother.

The commander of a squadron at Whidbey Island Naval Air Station was relieved Monday after being cited for driving under the influence in Anacortes on Sunday morning, public affairs officials said today.

 

Cmdr. Timothy F. Murphy had been commanding officer of Electronic Attack Squadron (VAQ) 129, which is a fleet replacement squadron for the EA-6B Prowler and EA-18G Growler platforms.

 

Capt. Christopher Shay, Commander of the Electronic Attack Wing Pacific (VAQWINGPAC), relieved Murphy "due to a loss of confidence in his ability to command," a statement from the Navy's public affairs office said.

 

"Our standards of conduct and performance for commanding officers are extremely high," the statement said.

 

Capt. John P. Springett, deputy commander of VAQWINGPAC, has assumed command of VAQ129 until a permanent replacement is chosen.

Everett Snohomish County DUI Lawyers: Stillaguamish Tribe helping Snohomish County Prosecuting Attorneys fight DUIs

 

EVERETT, Wash. (AP) — The Snohomish County Prosecutor's Office is getting some help from the Stillaguamish Tribe.

The Herald newspaper reports that the tribe agreed to donate $86,000 so that Prosecutor Mark Roe wouldn't have to cut another deputy prosecutor handling misdemeanor cases such as domestic violence and drunken driving (Everett DUI cases).

Prosecutors handle about 10,000 cases a year in Snohomish County District Court. Two years ago, the office had a dozen deputy prosecutors assigned to those cases. Due to budget cuts, that number is down to eight.

 

Roe decided to ask the tribe for help rather than cut another position. Tribal leaders say that as neighbors, they too have a strong interest in DUI enforcement and domestic violence prosecutions.

 

No information was provided regarding the details of the assistant.  How the Tribe is helping fight DUI cases in Everett and Snohomish County is completely unknown.
