Can Potential Employers see if I've been charged with a Snohmish County DUI, King County DUI, Skagit County DUI, Island County DUI or Completed a Diversion Program?

By Riley S. Lovejoy, Attorney at Law – Private Employers cannot request your entire criminal history; unauthorized use of your personal information is a crime.  Such information includes (1) Arrests that did not lead to a conviction, (2) Participation in a pretrial diversion program that is successfully completed, (3) Juvenile records and (4) Expunged records (Although in Washington State you cannot expunge a DUI from your record).  So If your conviction is dismissed or expunged, you have the right to answer “no” if you are asked if you have been convicted of a crime.  However, some employers, considered “Special Employers” (those serving “vulnerable” people i.e., children, sick people, elderly) have access to your entire criminal history.  The same goes for government employers and of course, law enforcement agencies.

Washington State schools chief sorry for DUI

The state's head of schools, Superintendent Randy Dorn, sent an apology to reporters today for his actions over the weekend.
Dorn, 56, was arrested early Sunday for suspicion of driving under the influence.
His statement today explains more of his actions:
I understand the public wants to know more about my recent citation. I am not at liberty to discuss the legal aspects of this case, but I can now share more information.
First and foremost, I want to apologize for what happened last Saturday night. My wife, our sons and I attended the annual crab feed and dance at Swiss Sportsman Club Park in Bonney Lake. My family has long supported the club. As members, we stayed late to help clean up the hall. I drank beer during the event, but I thought I was capable of driving home. I now know that drinking any amount of alcohol before driving is an extremely poor choice.
Today, my attorney has asked the city of Orting to release all the documents regarding this case because the public has a right to see this information. I am pleased the court has moved my hearing date from Monday, April 6, to Friday, April 2, to begin to address this matter sooner.
This week, I have continued to do the job the people of this state elected me to do. This morning I attended an important meeting with Gov. Chris Gregoire regarding our state's application for the federal "Race to the Top" grant. Next week, I will take a long-planned vacation with my wife – a school librarian who will be on spring break.
Again, I want everyone to know how sorry I am for what happened on Saturday. I have caused hurt and embarrassment to my family and I have disappointed my supporters and my staff. I work hard every day for the school children of this state and it pains me deeply that I have not set a good example for them. I will work hard to earn back your trust and I pledge that I will never make this mistake again.

Island County to lose Prosecuting Attorney Position - will this affect your Island County DUI?

Months ago the Island Prosecuting Attorney’s office declared that they would have to eliminate a prosecuting attorney position due to budget cuts.  This is disappointing to most in the legal community because it means that in all likelihood a well trained prosecutor will no longer be prosecuting cases in Island County District Court.  Further, a good person will be lost due to lack of money.  Because of this removal of a prosecutor the remaining prosecuting attorneys will have to shoulder more of a load.  This will undoubtedly put pressure on their office as it is unlikely the number of cases filed will decrease.

It is interesting that politicians campaign on being tough on crime and DUIs yet the budget results in cutting a valuable resource that helps prosecute those charged with DUI.  The result of one less prosecutor in a very small prosecuting attorney’s office will no doubt result in more DUIs being amended to less severe offenses.  How could it not?  As a DUI attorney I will, and my office will, continue to push every case to its limits and we will certainly not back off simply because the prosecutor’s office has fewer prosecutors.  Interesting times in Island County and DUI defense lie ahead.

On March 26, 2010, a driver accidentally crashed his SUV into the front of Dick's Restaurant. Stopped for a King County DUI, Snohomish County DUI, Skagit County DUI, or Island County DUI? Did You Know Your Passengers are Allowed to Calmly Leave the Scene?

By Riley S. Lovejoy, Attorney at Law - Does the Washington Constitution Article I, § 7 permit the police to detain a passenger in an automobile at the scene of a traffic infraction if the passenger wishes to depart, the police lack reasonable suspicion the person is engaged in criminal activity, and the person poses no apparent danger to the officer?  The simple answer is no. see  State v. Mendez, 137 Wn.2d 208 (1999).  In the Mendez case, Yakima police lawfully stopped a car in which Efrain Mendez was a passenger.  Once the car came to a stop, both the driver and Mendez got out of the car, and Mendez began to walk away.  When the police ordered Mendez to return to the car, he started to run.  When the  police finally caught up to Mendez, they found a pipe used to smoke marijuana in his pants pocket, and he was charged with possession of drug paraphernalia.   In this case, the Washington Supreme Court attempts to strike an appropriate balance between the concern for officer safety and the constitutional privacy interests of passengers who are not suspected of committing a crime.  As a passenger, Mendez was not stopped on suspicion of criminal activity.  Further, the officers failed to articulate how, by walking away from the traffic stop, Mendez posed a danger to the officers.  Since the police had no probable cause to stop Mendez after he left the vehicle, the Washington State Supreme Court ruled the marijuana pipe obtained from the search must be suppressed.

Attn : Snohomish, Island, Skagit, King County DUI Suspects : DUI Tip From Anonymous Informant Does Not Justify Investigative Stop of Your Vehicle

By Riley S. Lovejoy, Attorney at Law – A vehicle cannot be stopped because an anonymous citizen reported that the driver was intoxicated.  The citizen must first identify themselves and volunteer facts that support their allegation.  The circumstances must suggest (1) that the informant is reliable, and (2) that the information relayed is supported by objective facts which the police officer can evaluate for accuracy.  Otherwise, the stop of the vehicle is improper, and the DUI must be dismissed.  See  Campbell v Department of Licensing, 31 Wn. App. 833, (1982).

Hard to believe that so many continue to drink and drive

By Julie Muhlstein
Herald Columnist

Way back in 2003, I was in a crowded banquet room in Mountlake Terrace to hear a powerful person acknowledge disgrace. The stinging message began like so many expressions of regret, with the words “if only.”

“If only I had heeded the advice I repeated over and over as a mother and as a judge: If you drink, don't drive,” then-State Supreme Court Justice Bobbe Bridge said.

Bridge spoke that day to the Rotary Club of Lynnwood at Ballinger Lake Golf Course. The jurist's talk on Dec. 11, 2003, was one of several public appearances required by the state Commission on Judicial Conduct after Bridge was arrested in Seattle and charged with driving under the influence of alcohol.

American Idol Star Sanjaya drove 110 mph and Isn't facing Reckless Endangerment Charge. How about Reckless Driving?

By Riley S. Lovejoy, Attorney at Law – http://seattletimes.nwsource.com/html/entertainment/2011439631_apuspeoplespeedingidol.html  Washington State Trooper MacDonald may be right; there may not have been anyone else on the freeway at 2:30 a.m. when Sanjaya was stopped for driving 110 mph in a 60 mph zone.  And according to the Revised Code of Washington (RCW 9A.36.050 to be exact), which describes Reckless Endangerment as “reckless… conduct… that creates a substantial risk of death or serious physical injury to another person” (emphasis added), Sanjaya may not be guilty of Reckless Endangerment.  But what about charging him with Reckless Driving?  RCW 46.61.500 describes someone guilty of Reckless Driving as “any person who drives any vehicle in willful or wanton disregard for the safety of persons or property.”  Both crimes are gross misdemeanors, but if found guilty of Reckless Driving Sanjaya would automatically lose his license for 30 days (RCW 46.61.500).

Travel to Canada Restricted if Convicted of Washington DUI; Vacation possible with Temporary Resident Permit; Removal of Inadmissible Status possible with Minister's Approval of Rehabilitation

By Riley S.  Lovejoy, Attorney at Law – The Canadian Government views DUIs as a very serious offense.  Simply put, if you are convicted of a DUI in the US, you will not be permitted into Canada.  However, there are a couple of ways around this restriction.  First, you can remove your “inadmissible” status by applying for a Minister’s Approval of Rehabilitation five (5) years after the end of probation.  In Washington, the probation period for a DUI conviction is anywhere from the minimum two (2) to a maximum of five (5) years, with most Judges imposing the maximum five (5) years probation.  Alternatively, if you are convicted of a DUI and seek entry to Canada for a just a single or limited period, you can apply with the Canadian Government for a Temporary Resident Permit and pay the requisite  fee.

Difference between BUI and DUI penalties in Washington State; Mandatory Minimum Penalties, Driver's License Suspension, IIL, Breath or Blood Test

By Riley S. Lovejoy, Attorney at Law-  For a BUI, there are no mandatory minimum penalties while for a DUI conviction, the mandatory penalties include one day in jail (for first offenders) and fines.  For a BUI, there are no consequences to your driver’s license, nor is there a mandatory Ignition Interlock Device requirement.  Also, there is no automatic license suspension if you refuse to take a breath or blood test after your BUI arrest.  If you are arrested for BUI and asked to take a breath or blood test by a law enforcement officer, it would be advised that you exercise your rights and politely decline to take it.

BAC Test Results for DUI Cases now Reliable says King County Prosecutor! Really?

After you read the following article remember this:  when the issue regarding the toxicologist’s office first arose more than two years ago the toxicology lab and the prosecutor’s office (King County, Snohomish County, Skagit County, Island County)  all declared that everything was “okay” and that BAC tests were therefore valid.  However, it was found that the toxicology lab and their employees had lied about validating simulator solutions and that some of their employees had actually committed perjury.  Yet, the prosecutor’s offices though-out the State and the toxicology office all declared that despite the known issues that BAC readings were still valid!  The old adage “good enough for government work” was alive and well.

Thankfully Judges in King County saw the problem and ordered that all BAC tests be suppressed.  Judges in Snohomish County agreed and suppressed all BAC results in DUI cases.  Skagit County Judges compromised and despite their obvious lean toward the prosecutor’s office did suppress certain BAC tests in DUI cases.  Island County judges did not agree, for reasons unknown (although reputation declared their decision not surprising) they decided that despite the obvious problems, lying, and perjury, that BAC tests were valid.  Go figure!

Now the prosecutor’s say that the problems (which they never really admitted affected BAC tests) are fixed and all is okay?  Do we believe them?  Perhaps we do but the truth is that other problems exist and will soon be coming to the fore – check out Pierce County and the soon to be argued BAC motion for DUI cases in Snohomish County.

In the mean time check out this story in the Seattle Times – it may affect your DUI Case in King County!

ARIDE-trained Washington State Trooper nails driver on I-405 for DUI

Submitted by Ray Marcham on Thursday, March 18th, 09:18am
A trooper who had recently been trained in better recognizing impaired drivers got to use his training Wednesday morning on I-405.
The Washington State Patrol put out a media release on Wednesday night talking about four DUIs that were caught Wednesday morning by King County-based troopers trained in Advanced Roadside Impaired Driving Enforcement (ARIDE) techniques.  ARIDE classes help officers become more proficient in detecting, testing and apprehending impaired drivers.
One of those four King County stops was on southbound I-405 inside Bothell.  A trooper stopped a car that was making unsafe lane changes.  The driver, a 23-year-old from Everett, was arrested for DUI and possession of marijuana.  The arrest was made at 11:20 a.m.
WSP says there are 50 troopers in King County who have ARIDE training.

Teen guilty of Snohomish County DUI that injured Edmonds Officer

Teen guilty of drunken driving, fleeing scene of wreck that injured officer

EVERETT — The teenage son of a Snohomish County Superior Court judge confessed Friday to driving drunk and fleeing from a crash that injured an Edmonds police officer last year.
Peter Anthony Lucas, 19, pleaded guilty to running from the scene of an injury accident. That's a felony. He also pleaded guilty to drunken driving, a gross misdemeanor. He was sentenced to seven months in jail.
Lucas will be able to serve two months on home electronic monitoring on the campus of the University of Massachusetts Amherst, where he is a pre-med student. Another month was converted to 240 hours of community service. He may be able to serve the remaining four months on work release, according to court documents filed late Friday afternoon.
Lucas is the son of Superior Court Judge Eric Lucas.
Former Snohomish County Prosecutor Janice Ellis requested that Island County Prosecutor Gregory Banks handle the case to avoid a potential appearance of a conflict of interest. King County Superior Court Judge Bruce Hilyer oversaw Friday's plea and sentencing.
Lucas initially was charged in July with four felonies, including vehicular assault, assault on an officer and attempting to elude police. Prosecutors alleged that Lucas rammed an Edmonds police officer's patrol car during a pursuit on New Year's Day, 2009. The officer received substantial injuries to his neck that caused him to be out of work for three months.
The incident began when an Edmonds officer attempted to stop a Honda Civic. The driver stopped in a parking lot, then sped toward the officer's car, according to court papers.
The impact of the collision stalled the patrol car and injured the officer. The Honda left the scene. A few minutes later another Edmonds officer spotted two men attempting to change a flat tire on a damaged Honda Civic. The officer ordered the men to stop.
Peter Lucas got behind the wheel and tried to ram a police car but instead lost control and crashed, according to court papers. He was subdued with an electric shock from a stun gun.
Lucas earlier had been drinking at a party. He got scared when the officer attempted to stop him, according to his attorney Laura Martin, with the Snohomish County Public Defender's Association.
He was "scared for his future, for what his parents would do to him for drinking and driving, for how this would affect his schooling. He made a grave mistake." Martin wrote in court papers.
Lucas had no previous criminal history. An assessment revealed no drug or alcohol addiction, according to court papers.
"Mr. Lucas will forever be a convicted felon," Martin wrote. "This conviction, in and of itself, will have dire consequences for his future."

Deadliest Catch Star has Washington State DUI dismissed

"Deadliest Catch" star Jake Harris -- arrested last month for DUI, hit-and-run and much, much more -- had his DUI case dropped yesterday ... which is what normally happens when you blow a .00.
And it gets better for Jake ... even though he admitted to having a prescription for Xanax -- cops had no evidence he was driving under the influence of the med.
And there's more good news for Mr. Harris. Although an imprint of what looks like Jake's license plate was found on the car he allegedly hit ... he wasn't charged with hit-and-run because witnesses couldn't place him behind the wheel.
Jake was charged with driving on a suspended license and reckless driving. He's due back in court on March 26.

DUI Police Officer fired based on new DUI law

By Meghann M. Cuniff
The Spokesman-Review
SPOKANE — Changes to a state law put a fired Spokane police sergeant in a new class of drunken drivers: first-time offenders required to drive with an ignition interlock device.
That new requirement led to Brad Thoma's dismissal from the Spokane Police Department after the department said public safety would be compromised by having an officer who had to pass a breathalyzer test any time he needed to start his patrol car. It appears to be the first time a law enforcement agency statewide has had to consider the issue.
