Difference between BUI and DUI penalties in Washington State; Mandatory Minimum Penalties, Driver's License Suspension, IIL, Breath or Blood Test

By Riley S. Lovejoy, Attorney at Law-  For a BUI, there are no mandatory minimum penalties while for a DUI conviction, the mandatory penalties include one day in jail (for first offenders) and fines.  For a BUI, there are no consequences to your driver’s license, nor is there a mandatory Ignition Interlock Device requirement.  Also, there is no automatic license suspension if you refuse to take a breath or blood test after your BUI arrest.  If you are arrested for BUI and asked to take a breath or blood test by a law enforcement officer, it would be advised that you exercise your rights and politely decline to take it.
