Lynnwood DUIs: If you get a DUI in Lynnwood you may lose your car!

The notice that you (or your attorney) may be provided by the prosecutor reads, in part, as follows:

NOTICE NOT TRANSFER, SELL, OR ENCUMBER VEHICLE PENDING DISPOSITION WITH INTENT TO SEIZE AND FORFEIT:

That upon the conviction for a violation of RCW 46.61.502 or RCW 46.61.504, you are further advised that it is the intention of the CITY OF LYNNWOOD to proceed to seize and forfeit said vehicle.

Skagit County DUI News: Young Man in an Old Truck Hits House and then Charged with Skagit County DUI

On July 23, a 21-year-old Anacortes man was hospitalized after the 1972 Chevrolet truck he was driving left the roadway in the 900 block of 29th Street and struck a house around 2:40 a.m. Witnesses said the man was traveling at a high speed and appeared to be chasing another vehicle when the crash occurred. Police obtained a blood sample at the hospital and are investigating the incident as a DUI.

Skagit County Woman Caught Weaving then Donated Blood for DUI

On July 21st in Skagit County a 34-year-old Anacortes woman was arrested on a charge of DUI after another motorist called 911 to report an erratic driver. An officer caught up with the vehicle on Highway 20 at March Point and also saw the car was weaving in and out of the lane of travel. The woman was arrested and transported to Island Hospital for a blood alcohol test.

Skagit County Man Arrested for DUI and Pot

On July 18th in Anacortes, Skagit County a 22-year-old Anacortes man was arrested on charges of DUI and possession of a small amount of marijuana and drug paraphernalia after an officer stopped the car the man was driving for a minor violation. The officer smelled marijuana and the driver allegedly admitted he had been drinking. The man was arrested and taken to the police station for a BAC

Skagit County Man Allegedly Commits DV and DUI in One Evening

On July 16th in Anacortes, Skagit County a 49-year-old man was arrested on a charge of DUI after officers responded to his residence for a reported domestic argument around 8:43 p.m. While en route, officers were told the man involved left in a vehicle. Officers spotted the car eastbound on Highway 20. The car stopped at Sharpes Corner and the man got out and contacted the officer. He was arrested and taken to the police station for a Breathalyzer test.

Washington State DUI News: Police up patrols at heavy DUI spots

Washington State troopers and local police think they have a more effective, targeted way to stop drunk drivers.

The campaign,  in King, Pierce and Snohomish counties, puts full-time DUI teams on the road in known trouble spots.
"We've mapped it and looked at it and said 'Where are the highest concentrations of crashes that result in death or serious injury as a function of impaired driving," says Lowell Porter, Director of the Washington Traffic Safety Commission.
Officers will be on the roadways looking specifically for impaired drivers.

Washington State DUI News-DUI Stop turns Fatal

Silverdale - A 23-year-old Bremerton man was fatally shot during a DUI traffic stop Friday night, the Kitsap County Sheriff's Office reported. The shooting occurred at 10:30 p.m. in the parking lot of Timberland Bank, 2401 N.W. Bucklin Hill Road, in Silverdale.

Whatcom County DUI News

In Whatcom County this past weekend deputies made two DUI arrests and Richland police jailed four impaired drivers, officials said.  Kennewick police reported just four DUI arrests throughout the city, with two arrests occurring inside Columbia Park on Sunday, said Sgt. Ken Lattin. The story was the same in Pasco, where officers made just two DUI arrests from Friday to Sunday, said Capt. Jim Raymond.

Skagit County DUI News: City of Burlington finds another way to stop DUI drivers

Burlington police could get a new traffic enforcement tool if the City Council approves a proposed inattentive driver ordinance. A recent decision by the Burlinton City Council opens the door for police to stop any driver for just about anything that seems to be causing that driver to lose focus on the road. Eating a cheeseburger? Applying lipstick? If an officer thinks you're distracted, you may find yourself with a $42 ticket (or more if a judge deems it fitting). Good luck out there!  Seriously though, do not drive after drinking.  It's the only way you won't get investigated for DUI.

Anacortes Man Stopped and then is Popped for DUI

On July 13 in Anacortes, Skagit County, a 24-year-old Eastsound man was arrested on a charge of DUI after an officer saw his vehicle driving slowly and then stopping completely in his lane of travel.  He was then processed for DUI by Anacortes police.

Snohomish County DUIs to Increase with Speed Patrol Task Force

STANWOOD -- Police in Snohomish County are cracking down on speeders.  Officers around the county will step up patrols as part of a state-funded grant to reduce speed-related crashes on city and county roadways.  Data shows that 87 percent of the people killed in high-speed crashes are men. Nearly half of those are 25 or younger, said Tracy McMillan, manager for the county's DUI and Target Zero Safety Task Force.  The grant will pay for more patrols through Aug. 1.

Seattle woman with kids in car arrested for DUI-King County DUI

A mother on a trip from Seattle with her two children crashed her car Friday night in Oregon and was arrested for driving drunk, police said. The children, both under 10 years old, were not injured.  Her BAC was 0.29.  Rattray was booked into the Clackamas County Jail on suspicion of two counts of reckless endangering.

Woman flashes breasts, bites herself after DUI arrest

FORT WALTON BEACH – A woman kicked a patrol car, flashed her breasts, tried to bite a deputy and bit herself, all while being booked for DUI.  On July 3rd, in Fort Walton Beach, Florida,

Sherry Jean Fuscaldo, was arrested for DUI.  After Fuscaldo was taken to the Shalimar Annex, she undid her bra and pulled down her shirt, exposing her breasts, the report reads. The arresting deputy didn’t see it happen, but the nudity was caught on tape.  “The defendant also attempted to bite me again but bit herself in the process,” the report reads.  She was charged with resisting an officer with violence, as well as DUI. She is due in court Aug. 3.

Snohomish County Evergreen Division Denies DUI Uncertainty Motion

Recently in the State of Washington DUI Defense lawyers have been raising an issue in courts arguing that unless the State (or City) can prove the reliability of the BAC breat test machines then the evidence obtained must be suppressed.  The very basic idea is that there is a margin of error in these results, as with any machine, and that the State/City should supply to the Defendant what the margin of error is.  The State and City, by way of the Washington State Toxicology Laboratory, has failed to do this.  Anyway, the Judges in Evergreen Division, Snohomish County, heard this motion on July 16th, 2010, and ruled that the evidence is not to be suppressed by that the State must provide the margin of error if requested by the Defense.  Mixed results but it does keep the State honest - which is nice and frankly, an absolute requirement in keeping the system fair and just.For information on your Washington State DUI please contact our Snohomish County DUI attorneys, King County DUI attorneys, Island County DUI attorneys, Whatcom County DUI attorneys, or Skagit County DUI attorneys at 425-493-1115 or check out our website at http://www.washdui.com

The Prosecuting Attorney is an elected position,  partisan, 4-year term. Duties are established by state constitution and statutes.

Mission: To represent the interests of the State of  Washington in the prosecution of criminal actions occuring within Whatcom County; to  provide legal advice to County officials and employees; to represent and defend the County  in all civil actions in which the County is a party.

Areas of responsibility include:

  •  District Court: Violation  of state statutes involving misdemeanors and gross misdemeanors committed by adults or  criminal traffic violations by juveniles 16 & over; representation of the State's  interest at involuntary commitment hearings relating to alcohol abuse.
  •  Superior Court: Violation of state statutes involving felonies committed by adults, and all crimes  committed by juveniles; Representation of the State's interest at involuntary mental  commitment hearings; Civil practice includes paternity establishment, enforcement of child  support orders, tort actions, and defense of lawsuits brought against the County.
  •  Appellate Courts: Handle appeals of lower court decisions to the Court of Appeals, Washington State Supreme  Court and potentially to the United States Supreme Court.
  •  Legal Advisor to all County departments including the County Council and County Executive.
  •  Crime Victim  Assistance: Assist victims of crime with restitution recoupment process, as a  legal advocate facilitating prosecution and as a referral source for community services. Special assistance for victims of sexual assault and domestic  violence.
  • Law Library: Prosecutor currently serves as Chair of the Whatcom County Law Library Board of Trustees.

The Skagit County Sheriff's Office Traffic Division consists of five full time traffic deputies and one sergeant. The mission of the Traffic Division is to promote traffic safety in Skagit County through education and enforcement. The traffic unit participates in the Skagit County Traffic Safety Task Force and regularly participates in DUI emphasis and major traffic corridor safety projects and patrols. In 2005 the traffic division conducted the majority of 9,017 traffic stops conducted by the sheriff's office (a 16% increase from 2004).

To augment the traffic division the motorcycle program was started in 1997. Three deputies are assigned to traffic motorcycles and focus their enforcement in areas where it is difficult for a patrol vehicle to respond as well as during special events such as the Skagit County Tulip Festival where traffic congestion prohibits patrol vehicles from a timely response to calls for service. In addition to patrol and traffic functions, the motorcycles are also used as escorts for motorcades and parades.

Snohomish County DUIs: After the Arrest

If you have been arrested for DUI in Snohomish County and not received a citation (a ticket for DUI) or a court date, you may be wondering what happens next?  Good question.  A couple of years ago the Snohomish County Prosecuting Attorney's Office thought it would be wise to charge DUI defendants well after they had been arrested.  What has resulted in is severe delays in the charging process and court appearances.  So, if you have been arrested for DUI in Snohomish County what will happen is that the Trooper/Sheriff will forward to the prosecuting attorney's office a report detailing your arrest and DUI process.  The prosecutor will review your case and if they agree to charge you with DUI, and they will, they will then send a summons to you that details when and where you are to appear to be formally arraigned on charges of DUI.  Generally this occurs (the DUI arraignment) about 6-8 weeks after your arrest.

Whatcom County Prosecuting Attorney letter to DUI Defense Attorneys regarding DUI BAC Results

As another batch of problems arise with the Washington State Toxicology Lab (namely their reluctant to provide information about the accuracy of the BAC results - the "uncertainty" motions, as they are being referred to), it is time to reflect upon the last time this Lab was in strife.  If we turn back the clock two years we remember the Toxicology Lab fraud and the resultant backpeddling from prosecuting attorney offices around the State.  What follows is a letter from the Whatcom County Prosecuting Attorney's office and their dealing with the problem.

Dear Colleagues:

I am writing regarding the myriad of motions that have been filed surrounding the Washington State

Toxicologist and State Toxicology Lab. Having reviewed much of the record and all of the decisions

rendered by the Courts around the state, I would note that both of the following cases are persuasive.

King County District Court decision, State v. Ahmach, Sanafim, ET AL. issued January 30, 2008, which

held for the defense, suppressing the BAC result; and Snohomish County Superior Court decision, State

v. Russeff, issued January 22, 2008, which held for the State, denying the defense's motion to suppress

the BAC result. The conflicting results notwithstanding, the analysis in both cases is well taken and is

consistent with the Supreme Court decision City of Fircrest v. Jensen, 158 Wn.2d 384 (2006) and

Justice Madsen's opinion in City of Seattle v. Ludvigsen, SL OP 799741

(December 20, 2007).

Accordingly, it is the decision of the Whatcom County Prosecutor's Office that in cases where the

charge filed is RCW 46.61.502, Driving Under the Influence of Intoxicating Liquor, RCW 46.61.504,

Physical Control While Under the Influence of Intoxicating Liquor, or 46.61.503, Minor Operating, the

State will not seek to admit at trial any BAC result run with a simulator solution from a batch approved

by the State Toxicology Lab prior to Batch 07026. In all but a few instances, this decision will only

affect tests run prior to August 24, 2007. It is the belief of this office that solutions from Batch 07026

onward do not suffer from the procedural or substantive errors, which have been the basis of the above

referenced motions and court decisions.

Those pending cases falling within the subject time period, will be evaluated on a casebycase

basis.

Where evidence is sufficient, DUI and Physical Control charges will be litigated under the appreciably

affected prong of the statute.

The recently released DUI App for the Accused, available on iTunes, is receiving National Recognition due to its creativity and the value of its information.  The first DUI App in the Country is also a very valuable resource for those accused of DUI.  The information is valuable for anyone accused of DUI in any State and the App contains over 100 pages of information.  Available on iTunes for only $3.99.  This App was recently acknowleged as a necessary tool for anyone accused of DUI by a prominent police law enforcement author.

City of Lynnwood Police Department to Use Cameras in Cars for Lynnwood Municipal Court DUI cases

Finally there is a City in Snohomish County that has the financial ability and legal nuance to install and utilize cameras in their patrol cars.  Starting soon the City of Lynnwood Police Department will have installed cameras in their patrol cars.  These videos should be obtainable by your DUI attorney and may help (or hurt) your DUI case in terms of video evidence relating to driving, field sobriety tests, observations of impairment, statements and so on.  Importantly this will also assist in determining officer credibility.  This will undoubtedly change the DUI landscape (good or bad) in the Lynnwood Municipal Court.  Keep checking back for updates.

Two injured in suspected DUI crash into tree in Burien Friday

Two men were injured in a single-car crash in Burien Friday night around 8:20 p.m. According to the State Patrol, a 45-year-old Burien man was driving a 1996 Pontiac Grand Am was exiting to S. 160th St. from northbound state Route 509.  The cause of the accident is under investigation, but the Patrol said drugs or alcohol were involved.

Snohomish County DUI becomes Island County DUI

On May 8, Snohomish County Deputies observed a blue 2005 Chevrolet car traveling 59 mph in a 45-mph zone. The Deputies followed the car into Island County and stopped it. The driver, a 44-year-old woman, smelled of alcohol and failed field sobriety tests.  She was transported to the Camano Annex precinct where her blood-alcohol content was measured at .111. She was cited in connection with driving under the influence of alcohol, speeding and illegally passing on the right.

DUI Driver in Island County Arrested after "nearly swiping the Deputy's Patrol Car."

On May 7, in Island County Washington, a deputy was parked on the shoulder of Good Road, facing SR 532 and observing traffic, when a white 1991 Mazda Navajo took a wide right turn off SR 532 and onto Good Road, nearly swiping the deputy’s patrol car. The deputy stopped the car, asked if the driver would voluntarily submit to field sobriety tests, and he said, “no.” Based on his observations, the deputy informed the man that he was under arrest.  He was eventually transported to the Camano Annex precinct, where his blood-alcohol measured .109. He was cited in connection with driving under the influence of alcohol, driving with wheels off the pavement and no proof of insurance.

Woman Fakes Fainting After DUI Arrest, so says Island County Deputy Sheriff

On May 4, deputies responded to a 911 hang up from a 43-year-old woman in a vehicle. They found the woman inside the vehicle, sobbing and clearly intoxicated.  She agreed to field sobriety tests, which she failed. She appeared unstable, and deputies decided she shouldn’t be left at home alone so she was arrested and provided a BAC sample of 0.231. She was transported to Island County Jail and guards then stated she “miraculously sprang to her feet.”

Island County Sheriff Mark Brown confirms a 21% increase in DUI arrests in past year

Island County Sheriff Mark Brown in contemplating a 10 percent reduction in funding, or more than $500,000, stated “that’s about seven deputies.”  Further, Brown stated that “[a] 10 percent cut to my office would undoubtedly affect public safety, as well as officer safety,” he said, and the two “are very much related.” Brown also stated that Island County has seen a 21 percent increase in DUI arrests since this time last year. Word to the wise for those drinking and driving in Island County!

Snohomish County Executive states that DUI is "Never an Option"

“Driving under the influence is never an option and only results in tragedy,” said Snohomish County Executive Aaron Reardon.

Snohomish County officials are urging drivers to be safe and sober and to plan ahead when attending summertime activities that might include alcohol.

On June 16, a 63-yearold Arlington man was arrested in the 8700 block of SR 532 after rear-ending a stopped vehicle. The man was later found to be intoxicated and was referred for DUI.

A deputy following a blue 1993 Ford pickup on July 4, witnessed the truck driving erratically and stopped the vehicle near the intersection of Olsen Road and Utsalady Road. The 19-year-old female driver woman agreed to sobriety tests, which she failed, and to a preliminary breath test, which registered her blood-alcohol level at .104. On June 3, a deputy received report of a possible DUI related to a gold 1996 Toyota Tacoma. The deputy located the truck and observed that it was driving erratically. Approaching the vehicle, the deputy smelled intoxicants and saw a half-gallon bottle of rum on the floor. Based on the man’s condition, he was arrested in connection with driving under the influence of alcohol. As the deputy was preparing to transport the man to Camano precinct, the man said his 3-year-old daughter was in the back seat. The deputy found the girl lying across the backseat unrestrained, sleeping. A second deputy arrived to take the child to the precinct and wait for the grandmother to pick her up. He was cited in connection with driving under the influence of alcohol and reckless endangerment.

Mukilteo DUI charged despite low BAC

Sleepy little Mukilteo (for those of you unfamiliar, it is located on the water between Everett and Lynnwood) seems like a pretty safe place to drive after a drink or two, right?  WRONG.  Last night Mukilteo PD stopped, arrested, and charged a driver with DUI after his BAC was 0.05 (significantly under the legal limit).  It can happen to you too so do not consume any alcohol and drive in Mukilteo or you too could be facing the court system and a possible DUI conviction.

Lynnwood DUI cases - changes that might affect you!

If you have been charged with a DUI in the City of Lynnwood and have appeared in the City of Lynnwood Municipal Court, you know how difficult the process is and how tough the Judge and Prosecutors are.  Additionally, the City of Lynnwood has for many years had a reputation of having well stocked and well prepared police officers.  However, times they are a’changin’.  This past month has seen the City of Lynnwood Police Department release seven (7) of its officers due to budget changes.  Although the emphasis on DUI drivers will not be relinquished the truth is with fewer officers and the same area to patrol one has to think that DUIs in Lynnwood will not continue to escalate in numbers.  Obviously still be careful, don’t drink and drive in Lynnwood (or anywhere else), but be aware that Lynnwood may slowly be releasing its reputation as a police state.  As a reminder, I’m a former City of Lynnwood Prosecuting Attorney so this recent development is rather interesting to me.  DUI cases cannot help but be affected.  Stay tuned…

Island County DUI cases and the Barefoot Bandit - Is there a connection?

We have all heard recently of the exploits and then capture of Colton Harris-Moore, aka the Barefoot Bandit.  Yes, a troubled teen whose crime spree started with a few ‘innocent’ house break-ins and then turned into a movie plot with stolen aircraft, crash landings, living in the woods, then flying across country and arriving in the tropical oasis of the Bahamas.  Quite the story.  So, what is the connection to DUI cases in Island County?  Simply, the same Island County Deputies who could not find the Barefoot Bandit are the ones stopping drivers and citing them for DUI.

Does this apparent failure to locate a fugitive known by all on Camano Island help your DUI case?  Probably not.  However, remember, if a 19 year old can outsmart the local deputies there is a good chance a qualified DUI attorney can.  Hire smart!

Deferred Prosecution:  If you are considering a deferred prosecution be aware of individual court rules and practices.

For Skagit County District Court DUI Cases (this included the City of Mount Vernon, Anacortes, and Burlington), you must do the following to have your deferred prosecution accepted by the court.

1.       Complete the alcohol/drug evaluation;

2.       Submit the proposed Petition, Order, and Statement of Petitioner to the Prosecuting Attorney for their review;

3.       Appear in court for the entry of the deferred prosecution.

3.       Meet with the probation officer who will interview you and approve or deny your petition for deferred prosecution;

4.       Appear in court for the entry of the deferred prosecution.

For Snohomish County District Courts you must have completed 36 hours of the First Phase before the court will grant your Petition.  However, you must also provide to the probation department no less than one week before the following information:

1.      Petition for Deferred Prosecution;

2.      Order for Deferred Prosecution;

3.      Statement of Petitioner;

4.      Proof of installation for the Ignition Interlock License;

5.      Driving Status Form;

6.      Completed alcohol/drug evaluation;

7.      Proof of completion of 36 hours of treatment.

With out these steps your deferred will not be accepted by probation and therefore not entered by the court in Snohomish County District Court.

The Truth Comes Out of the Closet

Name: Roy Ashburn

Claim to Fame:  California State Senator

Date of DUI:  March 3, 2010

Facts:  Sen. Roy Ashburn, 55, a Republican from Bakersfield, was spotted driving erratically at about 2 a.m. Wednesday in downtown Sacramento, officials said. He was arrested after taking a sobriety test, and he was taken to Sacramento County Jail, where he was administered a blood-alcohol test prior to being booked and released.  He was charged with two misdemeanors: driving under the influence and driving with a blood alcohol level of .08 percent or higher.  Ashburn, a father of four, was arrested after leaving Faces, a gay nightclub in midtown Sacramento.  A male passenger, who was not identified as a lawmaker, was also in the car but was not detained.

Outcome: Ashburn pleaded no contest to the DUI charge.  He was sentenced to two days in jail and three years probation. He will also pay fines and fees of about $2,000, attend a mandatory first offender DUI program and have his license suspended for 30 days.

Did You Know? Ashburn, who served in the state Assembly from 1996 to 2002 before he was elected to the Senate, voted against every gay rights measure since he became a senator.

DUI Suspect Arrested after suspected hit and run, evading police, endangering passengers, driving recklessly, and causing property damage : DUI Attorney Mukilteo, DUI Lynnwood

Lovejoy, Attorney at Law – A man was arrested late last Saturday after crashing his Chevy Malibu into the corner of a Lake City home.  Officers had initially stopped the vehicle a mile away because it matched the description of a vehicle involved in a hit-and-run earlier in the evening.  The driver initially cooperated with the officers, but sped away with his three passengers.  After the crash, the driver and two female passengers attempted to flee, while the lone male passenger remained in the vehicle.  No one was injured, and the driver and the passengers were apprehended.  The driver was booked for DUI.  Read KOMO’s story here.

Name: Danielle Nantkes

Claim to Fame:  Nebraska State Senator

Dates of DUIs:  DUI #1: April 24, 1997, DUI #2: Aug. 22, 1997, DUI #3: Feb. 14, 2007

Facts: Lincoln police stopped Nantkes twice before on suspicion of drunken driving, both times when she was 19.  On Valentine’s Day 2007, Nantkes was driving at 1 am when she collided with a southbound front-end loader. The snow plow had not quite cleared the intersection at 19th Street when she hit its right rear.  Nantkes told the officer she tried to stop but couldn’t because of snow, according to the accident report. Police said the officer observed signs of impairment and said Nantkes smelled of alcohol, had slurred speech, noticeably impaired balance and bloodshot, watery eyes.  Nantkes allegedly refused to take field sobriety tests or a preliminary breath test at the scene and was taken to the police station, where she refused a chemical test.  Police cited her on suspicion of negligent driving, misdemeanor driving under the influence and refusal of a preliminary breath test and chemical test.

The vehicle she was driving reportedly sustained more than $1,000 in damage, however the city snowplow that she crashed into was not damaged.

Outcome: DUI #1:  Convicted of reckless driving and paid a $100 fine. DUI #2:  Convicted of first offense DUI and ordered to serve one year on probation and pay $200. 

DUI# 3: Plead guilty to DUI, given one year of probation and fined $1,000.

Did You Know? The Nebraska state Constitution allows that state senators — except in cases of treason, felony allegations or a breach of the peace — are privileged from arrest during the session and 15 days before and after.  The Lincoln City prosecutor waited until the legislative session was in recess before filing charges.

Swimmer Drinks Like a Fish

Name: Michael Phelps

Claim to Fame:  Olympic Gold Medalist Swimmer

Date of DUI:  November, 2004

Facts:  Phelps was stopped by a state trooper on Nov. 4 for running a stop sign near Salisbury University, about 85 miles southeast of Baltimore.  Phelps had a .08 blood alcohol content — the legal limit in Maryland.

Outcome: Phelps, 19 years old at the time, was sentenced to 18 months probation Wednesday after pleading guilty to drunken driving. Under the terms of his probation, Phelps must give speeches to students at three Wicomico county schools, advising youngsters about making choices and warning them about the dangers of alcohol.
Phelps was ordered to abstain totally from alcohol and illegal drugs during his probation and attend a victim impact panel meeting sponsored by Mothers Against Drunk Driving. He was fined $250 and ordered to pay $55 in court costs.  In return for Phelps' guilty plea to driving while impaired, prosecutors agreed to drop charges of driving under the influence, underage drinking and failure to stop at a stop sign. Under the terms of his probation, Phelps must report to a probation supervisor once a month by telephone or as directed by the court (the reason for that is because of his travel). Normally a probationer would have to report in person.

Did You Know? Phelps holds records for: Most Olympic Gold Medals (14), Most Olympic Gold Medals in Individual Events (9), and Most Olympic Gold Medals at a Single Games (8, Beijing 2008).

Bad Girl of Skating… Surprise! Also Bad Girl of Driving

Name: Tonya Harding

Claim to Fame:  Former skating champion

Date of DUI:  April 20, 2002

Facts: The former skating champion (and noted hubcap tosser) was busted early in the morning after running her truck into a ditch. Police responding to the one-car accident caught a whiff of "a strong odor of intoxicants coming from her breath," and a subsequent field sobriety test recorded a .16 blood alcohol level (twice the state limit of .08). The Clark County Sheriff's Officer reports on Tonya's poor attempt to recite the alphabet beyond the letter "t."

Outcome: Tonya was ordered to serve 10 days in jail for violating her probation from an earlier assault conviction by drinking alcohol.  She was just one month away from serving out her probation when she crashed her truck.

Did You Know? She was only the second woman and first American woman to complete a triple axel in competition.
