BAC Test Results for DUI Cases now Reliable says King County Prosecutor! Really?

After you read the following article remember this:  when the issue regarding the toxicologist’s office first arose more than two years ago the toxicology lab and the prosecutor’s office (King County, Snohomish County, Skagit County, Island County)  all declared that everything was “okay” and that BAC tests were therefore valid.  However, it was found that the toxicology lab and their employees had lied about validating simulator solutions and that some of their employees had actually committed perjury.  Yet, the prosecutor’s offices though-out the State and the toxicology office all declared that despite the known issues that BAC readings were still valid!  The old adage “good enough for government work” was alive and well.

Thankfully Judges in King County saw the problem and ordered that all BAC tests be suppressed.  Judges in Snohomish County agreed and suppressed all BAC results in DUI cases.  Skagit County Judges compromised and despite their obvious lean toward the prosecutor’s office did suppress certain BAC tests in DUI cases.  Island County judges did not agree, for reasons unknown (although reputation declared their decision not surprising) they decided that despite the obvious problems, lying, and perjury, that BAC tests were valid.  Go figure!

Now the prosecutor’s say that the problems (which they never really admitted affected BAC tests) are fixed and all is okay?  Do we believe them?  Perhaps we do but the truth is that other problems exist and will soon be coming to the fore – check out Pierce County and the soon to be argued BAC motion for DUI cases in Snohomish County.
