First, please do not drink and drive.  However, if you have been arrested for DUI and were chewing tobacco on the night of your arrest, you may have a ready-made defense.  A statutory requirement of a valid breath test includes having no foreign substances in your mouth.  It is well known that chewing tobacco migrates from your lip area to other areas of your mouth and between your teeth.  The only way to completely remove tobacco from your mouth is to remove (ie. spit it out), rinse, floss and brush.  Even this may not completely remove it from your mouth.  If the officer fails to allow you to rinse your mouth then you have a ready-made defense (and a very valid one) in your DUI case.  If the motion prevails, your breath test is suppressed (thrown out).
