On December11 a 60-year-old Seattle man was charged with negligent driving in the first degree in Anacortes, Skagit County after an Anacortes police officer saw the 2003 Acura sedan speeding in the 2400 block of Commercial Avenue in Anacortes around 11:50 p.m. After stopping the vehicle the man reportedly showed signs of intoxication that did not rise to the level of a DUI. The Anacortes police officer cited the man and released him. The Anacortes man showed good judgment but not citing the man for DUI but the question is, is he guilty of Negligent Driving First Degree? Not an easy case to prove, despite the belief of many prosecuting attorneys. Speeding is not in and of itself negligent, so good luck!
