In NHTSA's refresher training manual for field sobriety tests an article toward the back states that a DUI suspect cannot "fail" a field sobriety test as NHTSA does not use that language. This article is correct! So why then do so many police officers state in their reports and in live testimony that DUI suspects failed the field sobriety tests? The answer: because the police officers do not receive enough initial training and refresher training.
