By Riley S. Lovejoy, Attorney at Law – A vehicle cannot be stopped because an anonymous citizen reported that the driver was intoxicated. The citizen must first identify themselves and volunteer facts that support their allegation. The circumstances must suggest (1) that the informant is reliable, and (2) that the information relayed is supported by objective facts which the police officer can evaluate for accuracy. Otherwise, the stop of the vehicle is improper, and the DUI must be dismissed. See Campbell v Department of Licensing, 31 Wn. App. 833, (1982).
