Critics of the standardized field sobriety tests also included some within law enforcement. The California Highway Patrol criticizes the SFSTs and its Manual states that the “HGN is not a psychophysical test. The clues associated with HGN are not designed to be considered ‘signs of impairment.’”  Department of California Highway Patrol. Driving Under the Influence Enforcement Manual. Pages 2-12 (1995) Critics have argued that the SFSTs are not nearly as reliable as the studies allege and that officers do not always comply with the SFST procedures, the HGN measurement is not always exact, the reliability claims of the studies were misleading, the officers in the studies were more experienced than average (and given a refresher course immediately prior to testing), and so on Cole, S., Kulis, I., Nawaczyk, R., NHTSA and FSTs: True Lies and False Advertising. DWI Journal, Law & Science. 12:3. Pages 1-8. (March 1977). To that end, NHTSA states that “[i]f any one of the standardized field sobriety test elements is changed, the validity is compromised.” NHTSA, U.S.  Department of Transportation. HS 178 R8/06. DWI Detection and Standardized Field Sobriety Testing, Student Manual. Page VIII-19 (2006). Critics have argued that very few of the SFSTs are conducted in exact accordance with NHTSA rules.
