By Riley S. Lovejoy, Attorney at Law – The new cell phone law makes it a primary offense to have a cell phone up to your ear while driving. This includes sitting at a stoplight, and all roads including alleys. State Patrol say it’s okay to hold the phone in front of you with the speaker on, as long as it’s not up to your ear. Local police, however, may interpret the law to mean literally “hands free,” and could still give you a $124 citation. All police in Washington allow a driver to have speaker on and the phone on the dash or in the center console. Texting, of course, is a no-no. But again, some officers might not ding you if you’re sitting at a stoplight texting, while other officers might say that you need hands free to get out of the way of emergency vehicles. All officers agree you can dial or speak a phone number or command into your phone, just not when it’s up to your ear.
